These Terms of Use govern your access to and use of Gift Of The Game, including our website, platform, athlete pages, lesson videos, digital courses, emails, content, and related services.

By accessing Gift Of The Game, creating an account, purchasing a lesson, purchasing an athlete pack, or using our services, you agree to these Terms of Use. If you do not agree, do not use Gift Of The Game.

Gift Of The Game is operated by Gift Of The Game Inc. References to "Gift Of The Game," "we," "us," and "our" mean Gift Of The Game Inc.

You must be the age of majority in your jurisdiction to create an account, make purchases, or enter into a contract with Gift Of The Game.

Minors may use Gift Of The Game only with permission and supervision from a parent or legal guardian.

If you create an account or make a purchase on behalf of a minor, you are responsible for that minor's use of the platform and agree to these Terms on their behalf.

Gift Of The Game provides digital sports education content, including video lessons, athlete courses, training insights, and related materials.

Purchasing a lesson or athlete pack gives you a limited, personal, non-exclusive, non-transferable, revocable right to access the applicable digital content through your account.

You do not own the content. You may not download, copy, reproduce, resell, share, distribute, publicly display, screen record, upload, or commercially exploit any Gift Of The Game content unless we give you written permission.

We may add, remove, update, reorganize, or modify platform content at any time.

You are responsible for maintaining the confidentiality of your login information and for all activity under your account.

You agree to provide accurate account information and keep it updated.

You may not share your login with others, sell account access, bypass access controls, attempt to hack or disrupt the platform, scrape content, copy videos, or use the platform in a way that harms Gift Of The Game, athletes, partners, other users, or the security of the service.

We may suspend or terminate accounts that violate these Terms, misuse the platform, engage in fraud, share paid content without authorization, or create legal, security, or reputational risk.

Gift Of The Game may offer individual lessons, athlete packs, promotions, bundles, or other digital products.

Current launch pricing is: Individual Lesson: $19.99. Full Athlete Pack: $99.99.

Prices may change at any time. Unless otherwise stated, prices do not include applicable taxes, transaction fees, currency conversion fees, or charges imposed by your bank or payment provider.

You are responsible for reviewing the product description, price, currency, taxes, access details, and these Terms before completing your purchase.

All purchases are final and non-refundable except where required by applicable law.

Because Gift Of The Game provides digital content and access begins immediately after purchase, we do not offer refunds, credits, exchanges, or partial refunds for individual lessons, athlete packs, unused access, failure to use the content, dissatisfaction with the content, change of mind, accidental purchases, duplicate purchases, lack of athletic improvement, team selection outcomes, scholarship outcomes, competition results, or account cancellation.

If you experience a technical issue that prevents access to purchased content, contact us at support@giftofthegame.com. We may, in our discretion, attempt to restore access, provide troubleshooting support, or correct the issue. Technical support does not create a right to a refund unless required by applicable law.

Gift Of The Game content is for general educational and informational purposes only.

Gift Of The Game is not medical advice, physiotherapy advice, rehabilitation advice, strength and conditioning advice, or a substitute for professional coaching, medical care, or individualized training supervision.

Sports and physical training involve risk. You are responsible for using judgment, training safely, using proper equipment, following applicable rules, and consulting appropriate professionals before attempting any drill, technique, exercise, or training method.

Gift Of The Game does not guarantee improvement, performance results, injury prevention, roster selection, scholarships, recruitment, professional opportunities, or any specific outcome.

Gift Of The Game may feature athletes, coaches, teams, brands, sponsors, or partners.

Their participation does not guarantee that they personally review every user, provide individual coaching, endorse every product or claim on the platform, or assume responsibility for a user's training decisions.

All athlete names, images, likenesses, trademarks, and related content are used under applicable rights, permissions, licenses, or agreements.

All Gift Of The Game content, including videos, lessons, graphics, designs, logos, text, software, page layouts, course structures, trademarks, trade names, scripts, photographs, and related materials, is owned by Gift Of The Game or its licensors and is protected by copyright, trademark, and other laws.

You may not use Gift Of The Game intellectual property without our prior written permission.

If you submit comments, reviews, testimonials, messages, feedback, suggestions, photos, videos, or other materials to Gift Of The Game, you represent that you have the right to submit them and that they do not violate the rights of any other person.

You grant Gift Of The Game a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, display, distribute, and create derivative works from your submissions for platform, marketing, promotional, operational, and business purposes, subject to applicable law and our Privacy Policy.

We may remove user submissions at any time.

You may not use Gift Of The Game to violate laws, infringe intellectual property rights, harass others, upload harmful code, interfere with the platform, copy or redistribute paid content, share account access, misrepresent your identity, attempt unauthorized access, use automated scraping tools, reverse engineer the platform, or use the service for commercial purposes without written permission.

Gift Of The Game may use or link to third-party services, including payment processors, video hosting platforms, analytics tools, email platforms, advertising platforms, customer support tools, and social media platforms.

We are not responsible for third-party websites, services, policies, outages, actions, or security practices. Your use of third-party services may be governed by their own terms and privacy policies.

We aim to keep Gift Of The Game available, but we do not guarantee uninterrupted access.

The platform may be unavailable because of maintenance, technical issues, outages, security concerns, updates, third-party failures, or circumstances outside our control.

We may modify, suspend, or discontinue any part of the platform at any time.

We may suspend or terminate your account or access if you violate these Terms, misuse the platform, fail to pay amounts owed, create security or legal risk, share paid content without authorization, or engage in conduct that we determine is harmful to Gift Of The Game, our users, athletes, partners, or business.

Termination does not entitle you to a refund except where required by applicable law.

Gift Of The Game is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

Some jurisdictions do not allow certain exclusions, so some limitations may not apply to you.

To the maximum extent permitted by law, Gift Of The Game and its directors, officers, employees, contractors, athletes, partners, licensors, suppliers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of opportunity, injury claims arising from user training decisions, business interruption, or unauthorized access.

To the maximum extent permitted by law, our total liability for any claim related to Gift Of The Game will not exceed the amount you paid to Gift Of The Game for the specific product giving rise to the claim in the three months before the claim arose.

You agree to indemnify and hold harmless Gift Of The Game and its directors, officers, employees, contractors, athletes, partners, licensors, suppliers, and affiliates from claims, damages, liabilities, costs, and expenses arising from your use of the platform, your violation of these Terms, your misuse of content, your user submissions, or your violation of any law or third-party right.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any rights you may have under applicable consumer protection laws, you agree that disputes will be resolved in the courts located in Alberta, Canada.

We may update these Terms from time to time.

The updated version will be posted on the website with a new "Last updated" date.

Continued use of Gift Of The Game after changes are posted means you accept the updated Terms.
